Business Plans Program (CCR Title 19, H&SC Chapter 6.95)

A Business Plan is required whenever a business or facility handles, uses or stores a hazardous material or waste in quantities greater than or equal to the threshold mandated in the Health and Safety Code, Chapter 6.95.

Subsets of the Business Plans Program

The California Accidental Release Prevention Program Registration (CalARP) is used when a business or facility is handling, using or storing a Regulated Substance (RS) above threshold quantities. Download the CalARP Regulated Substance Listing for information about specific substances and quantities. A business or facility not required to complete a Business Plan may still be required to participate in CalARP.

A Risk Management Plan (RMP) is required of those facilities that have an RS above CalARP threshold quantities and are considered to have a factor that poses a higher than normal risk to people and the environment. Risk factors can include the location of a sensitive population such as schools, hospitals, and nursing homes within a certain distance to the facility; a health threat; and/or a contamination hazard. Any facility required to participate in CalARP may also be required to have an RMP, while non-CalARP facilities are rarely required to have an RMP.

Exemptions from the Business Plan Program

For questions not answered in the Business Plan Exemption Reference Sheet, contact the Business Plans Program Inspector for your jurisdiction. A business or facility exempt from the Business Plan Program or having substances in quantities less than the Business Plan thresholds may still be required to have a Hazardous Materials Management Plan (HMMP), including a Hazardous Materials Inventory (HMI), at the request of the local fire agency. Hazardous Materials Unified Program (HMUP)

In Santa Barbara County, the local fire agencies and the County fire agency work together in the inspection of Business Plan facilities. Inspections are done every three years if the facility is in compliance with the Business Plan requirements. SBCFD HMU shares the Business Plan program inspections with the Carpinteria-Summerland Fire District, Montecito Fire District, Santa Barbara City Fire Department, Lompoc City Fire Department, Santa Maria City Fire Department, and Vandenberg AFB Fire Department.
